
ETimes reached out to advocate Ayaz Khan, who had represented Fardeen Khan, Bharti Singh, and Haarsh Limbachiyaa, to find out what procedure will be followed tomorrow, leading up to Aryan’s release from jail.
We asked Ayaz to skip the law jargon and give us a layman’s lowdown on what will happen tomorrow after the court order allowed bail applications of all three accused today. The senior legal counsel obliged and cut all the legalese to give ETimes’ readers the skinny on the process in a step-by-step format. Take a look:
1. The order of the High Court will have to be sent to the Sessions Court.
2. The defence (counsels representing Aryan Khan, Arbaaz Merchant, and Munmun Dhamecha) will get the transcribed order.
3. They will have to go to the Sessions Court to execute the bail tomorrow.
4. They will have to file the order in the registry of the Sessions Court.
5. If the order mentions a cash bail, they will have to pay cash, if the order mentions a surety, then the defence lawyers will have to furnish a surety.
6. Once the cash bail is furnished or surety is executed, the Sessions Court registry will issue a release order, which has to be signed by the Sessions judge.
7. The release order has to be taken to jail, where once furnished, Aryan Khan will be released from the jail and be free to go home.
Depending on what time the final order is released from the HC, the defence lawyers will execute this process. If the order is released during the first half, chances are Aryan will go home tomorrow, but if the order is released during the second half, Aryan could go home to Mannat the day after.
