Aryan Khan case: Arbaaz Merchant’s father Aslam Merchant reacts to Bombay HC order; The right decision has taken too much time, irreparable damage has been done to the kids – Exclusive! – Times of India


On November 20, the Bombay High Court issued an order that stated no positive evidence of conspiracy was found between Aryan Khan, Arbaaz Merchant and Munmun Dhamecha to commit drug related offences. It was a huge relief to all three accused in the drugs case being investigated by the Narcotics Control Bureau (NCB). ETimes reached out to Arbaaz Merchant’s father Aslam Merchant to record his reaction to this order and his first statement was, “Justice delayed is justice denied. The right decision has taken too much time to arrive and in the course, irreparable damage has been done, which cannot be compensated in terms of money.”

Ever since Aryan, Arbaaz and Munmun were granted bail, all three have to visit the NCB office in Mumbai every Friday. After this new HC decision, would there be any change to those conditions? Aslam Merchant revealed, “That process is part of the bail and the bail conditions will not change until we file an application to modify the bail conditions. Since the HC statement has come out and the case is no longer as serious as it seemed, the conditions will have to be eased out.”

This new order by the Bombay HC acts as a relief to all three accused. But Merchant points out that their lawyers had been arguing the same point all along. He stated, “We were saying the same thing since day one, but they were arguing on the wrong footing. We should have been out in the killa court itself.” He also added, “From day one they were playing with us. First was the jurisdictional issue in Killa Court. This issue should not have been raised at all because the quantity recovered was very small. The Killa Court had the power to give an interim bail as well. But it was refused.”

Aslam Merchant feels that the system could have been more receptive to the conditions of Aryan and Arbaaz. But he is happy that the Bombay HC has taken cognizance of the real situation and given the right order.
